1. Terms of Use
   This Agreement is entered into by and between ClassifiedThailand.com and any individual, corporation, association, agency, company, or other entity who accesses or uses the ClassifiedThailand system (the "Advertiser" or "you"). When using ClassifiedThailand.com, you agree to the following terms and conditions (the "Terms of Use"). If you do not agree to these Terms of Use please do not use the site and do not post your ads. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms of Use at any time. Please check these terms periodically for changes.
   
   You acknowledge that all Content is the sole responsibility of the person from which such Content originated. This means that you are entirely responsible for all Content that you post, email or otherwise transmit via our Classified Ad System. ClassifiedThailand.com does not control all of the Content posted via the ClassifiedThailand System and, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the ClassifiedThailand System, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will ClassifiedThailand.com be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the ClassifiedThailand System.
   
   
2. User Conduct
   You agree not to use the ClassifiedThailand System:

   » to post false ads or email false questions to advertisers;
   » to post or email any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
   » to alter, damage or delete any Content or other communications that are not your own Content or to otherwise interfere with the ability of others to access ClassifiedThailand.com;
   » to post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or trusteeship relationships;
   » to post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
   » to post, email or otherwise transmit any material that contains software viruses;
   » to intentionally or unintentionally violate any applicable local, state, national or international law;
   » to violate any operating rule, policy or guideline of your Internet access provider or online service.
   
   
3. ClassifiedThailand.com reserve reserves the right, at its sole discretion, to remove any ad from its web site.
   
   
4. Intellectual Property
   You acknowledge that Content on ClassifiedThailand.com is generally provided by the ClassifiedThailand, individual advertisers, third party licensees, and/or other users. You may not modify, copy, reproduce, transmit, distribute, publish, create derivative works from, display or otherwise transfer or commercially exploit any of the Content, in whole or in part. Because ClassifiedThailand.com has no control over such sites and resources, you acknowledge and agree that ClassifiedThailand.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content.
   
   
5. Termination
   The only right with respect to dissatisfaction with any policies, guidelines, or practices of ClassifiedThailand.com in operating the ClassifiedThailand.com web site, or any change in Content, is for you to discontinue accessing the ClassifiedThailand.com web site. ClassifiedThailand.com may terminate or temporarily suspend your access to all or any part of the ClassifiedThailand.com System, without notice, for conduct that ClassifiedThailand.com believes is a violation of this Agreement or any policies or guidelines posted by ClassifiedThailand.com, or for other conduct which ClassifiedThailand.com believes, in its sole discretion, is harmful to ClassifiedThailand.com or other Users.
   
   ClassifiedThailand.com may discontinue operating ClassifiedThailand.com and terminate this Agreement without notice at any time for any reason in its sole discretion. In the event of termination, you are no longer authorized to access ClassifiedThailand.com, including the Interactive Areas, and the restrictions imposed on you with respect to Content downloaded from ClassifiedThailand.com, as well as the disclaimers and limitations of liabilities set forth in this agreement, shall survive.
   
   
6. Disclaimers, Warranties, Limitations of Liability
   ClassifiedThailand.com is not responsible for any defects or failures associated with the ClassifiedThailand or any damages (such as lost profits or other consequential damages) that may result from any such defects or failures. In addition, ClassifiedThailand.com makes no guarantees as to the sites and information located worldwide throughout the Internet to which you may access as a result of the use of the ClassifiedThailand.com.
   
   You acknowledge and agree that you and ClassifiedThailand.com are independent contractors under these Terms and Conditions. Should you violate these Terms and Conditions or any other rights we reserves the right to pursue any and all legal and equitable remedies against you, including, without limitation, deleting all your ads.
   
   You understand that except for Content, products or services expressly available at ClassifiedThailand.com, neither ClassifiedThailand.com, its subsidiary and parent companies, or affiliates, or their respective directors, officers, employees, and agents controls, provides, or is responsible for any Content, goods or services available through sites on the Internet linked to or from ClassifiedThailand.com. All such Content, goods and services are made accessible on the Internet by independent third parties and are not part of ClassifiedThailand.com or controlled by ClassifiedThailand.com System.
   
   ClassifiedThailand.com neither endorses nor is responsible for the accuracy, completeness, usefulness, quality or availability of any Content, goods or services available on any site linked to or from ClassifiedThailand.com, which are the sole responsibility of such independent third parties, and your use thereof is solely at your own risk. Neither ClassifiedThailand.com, its subsidiary and parent companies, or affiliates, or their respective directors, officers, employees, and agents shall be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused by your use of or reliance on any Content, goods or services available on any site linked to or from ClassifiedThailand.com or your inability to access the Internet or any site linked to or from ClassifiedThailand.com.

7. Indemnity
   You agree to indemnify and hold ClassifiedThailand.com, its parent or subsidiary companies and their affiliates, and their respective directors, officers, employees, and agents from any and all liabilities, claims and expenses, including reasonable attorneys fees, arising from breach of this Agreement, any other policy, your use or access of ClassifiedThailand.com or any Internet site linked to or from ClassifiedThailand.com, or in connection with the transmission of any Content on ClassifiedThailand.com
   
   
8. Miscellaneous/
   This Agreement comprises the entire agreement between ClassifiedThailand.com and you, and supersedes any prior agreements with respect to the subject matter herein. ClassifiedThailand.com may revise this Agreement or any other policy at any time and from time to time, and such revision shall be effective from the time and date of posting notice of such revision prominently on ClassifiedThailand.com.
   
   You agree to review this Agreement periodically to be aware of such revisions. If any such revision is unacceptable to you, you must discontinue accessing ClassifiedThailand.com. Your continued accessing and use of the e-Classifieds web site following notice of any such revision shall conclusively be deemed acceptance of all such revisions.
   The provisions of all sections of this agreement shall survive the termination or expiration of this Agreement. If any provision of this Agreement or any other policy be held invalid or unenforceable, that portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intention of the parties and the remaining portions will continue in full force and effect.
   ClassifiedThailand.com's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. This Agreement shall be governed by the laws of Thailand, excluding its conflict of laws rules, and you and ClassifiedThailand.com each submit to the exclusive jurisdiction of the courts of the Thailand. This Agreement is personal to you and you may not assign your rights or obligations thereunder to anyone. All logos, brand names, products, trademarks and service marks appearing herein may be the trademarks or service marks of their respective owners. References to any trademark, service mark and links to or from ClassifiedThailand.com have been done strictly for clarification and identification and does not constitute endorsement by ClassifiedThailand.com for any of the products, services or information offered by the owner of such trademark, service mark or link or endorsement of ClassifiedThailand.com by such trademark, service mark or link owner.
