Flash Points USA III - God & Country - Ken Starr
Kenneth Starr says "My own concern is reflected in the pledge of allegiance case now pending before the Supreme Court, and that is the use of judicial power especially federal judicial power in ways that seem to be anti-democratic, non-democratic and do not seem to have a strong textual basis in the Bill of Rights or the Constitution for the imposition of judicial views and judicial interpretations on the people. I think there has been an erosion of the right of the people to govern themselves, we saw that recently in the Massachusetts Supreme Judicial Courts determination by the narrowest of margins, 4 to 3 majority that gay and lesbian marriage was a matter of Constitutional right as opposed to social policy that should be the discussion and debate. One can agree or disagree with the policy, my concern is who gets to decide these kinds of fundamental, social issues." Continues to say that that seems to be a common theme within the traditional community, being concerned with traditions and values within the judicial process.
