Flash Points USA III - God & Country - Ken Starr

Kenneth Starr says "These kinds of questions should fundamentally be decided presumptively by the democratic process, through since we're a representative democracy, a representative institutions, there's great comfort in that. There's structural protections for the liberties of the people, the rights of the people and the traditions of the people by each state having a bicameral legislature, Nebraska's the exception, having a Governor, having an open process laws that require government in the sunshine and the like. The judicial process is not government in the sunshine, it's anything but. We don t know what was said behind those closed doors, those seven justices in Massachusetts. What we do know is that the three descending justices in that case, took the position, two of the three took the position that as individuals, as citizens they were in favor of gay and lesbian marriage, but they did not feel that that was their purgative as judges to impose their vision of the good society, the enlightened society on the rest of the commonwealth of Massachusetts."
