Law professor suggests concerns about President Biden using an auto pen to issue pardons in office at Senate hearing
Senate Judiciary Subcommittee on the Constitution Chairman Eric Schmitt asks University of Virginia School of Law James Madison Distinguished Professor John Harrison about the legal recourse if a presidential pardon were issued using President Biden's auto-pen without his actual direction, to which Harrison responds that there would be two key legal questions, with the first concerning whether improperly authenticated documents can still be treated as validly issued, explaining that while such legal rules exist in some contexts, he does not believe such a rule would apply specifically to presidential pardons.
